This matter is before the Court on Defendants Beachside Roofing L.L.C.’s (“Beachside”) Motion to Dismiss for Lack of Personal Jurisdiction and A-1 Master Roofing Inc.’s (“A-1”) Motion to Dismiss for Lack of Personal Jusitce. Defendants’ motions are based on the assertion that the case was improperly removed to this Court and that this Court lacks personal jurisdiction over the claims in the complaint.

The Plaintiff’s First Amended Complaint alleges breach of contract, unjust enrichment and conversion claims arising from the construction work performed on buildings in the Queens’ MarketPlace project in Hawaii. The complaint alleges that in December 2006 A-1 began installing a product manufactured by Soprema. A-1 was an approved installer under Soprema’s roofing contractor agreements. Under these agreements, Soprema required inspections of the installation work by its inspectors prior to issuance of the warranty.

Soprema alleged that the installation work was defective and subsequently filed the complaint in this Court seeking recovery for unpaid testing, supervision and inspection fees. Soprema alleges that the faulty workmanship and the parties’ efforts to repair it occurred entirely in Hawaii. In addition, Soprema’s affidavits establish that the company has ongoing business contacts with A-1 and Beachside.
